I. Terms and Conditions

§ 1 Basic Provisions

1. The following terms and conditions apply to contracts concluded between you and us as the provider (HARRIET HUBBARD AYER Parfümerie & Kosmetik GmbH) via the website https://ayer-cosmetics.de/. Unless otherwise agreed, the inclusion of your own terms and conditions is rejected.

2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self employed. An entrepreneur is any natural or legal person or legally capable partnership acting in the exercise of their independent professional or commercial activity.

§ 2 Conclusion of Contract

1. The subject of the contract is the sale of goods.

2. By listing a product on our website, we submit a binding offer to conclude a contract via the online shopping cart system.

3. The contract is concluded via the shopping cart system as follows:

   • Products are placed in the shopping cart.

   • The shopping cart can be accessed and modified at any time.

   • After entering personal data and selecting payment and shipping options, an order overview is displayed.

4. When using instant payment services such as PayPal or Amazon Pay, you may be redirected to the payment provider and then returned to our shop.

5. Before submitting the order, you may review, modify or cancel it.

6. By submitting the order, you legally accept the offer and the contract is concluded.

7. Requests for quotations are non binding. Binding offers may be accepted within five days unless stated otherwise.

8. Order processing and communication take place by email. Please ensure your email address is correct.

§ 3 Payment Methods

1. PayPal / PayPal Checkout
   Payments are processed by PayPal (Europe) S.à.r.l. et Cie, S.C.A., Luxembourg.

2. Mollie
   Payments are processed by Mollie B.V., Amsterdam.

§ 4 Retention of Title

1. A right of retention may only be exercised for claims arising from the same contract.

2. The goods remain our property until full payment has been made.

§ 5 Warranty

1. Statutory warranty rights apply.

2. Consumers are requested to inspect goods upon delivery. Failure to do so does not affect warranty rights.

3. Any deviations must be expressly agreed prior to contract conclusion.

§ 6 Governing Law and Jurisdiction

1. German law applies. Mandatory consumer protection regulations remain unaffected.

2. The place of jurisdiction for merchants is the registered office of the company.

3. The UN Convention on Contracts for the International Sale of Goods does not apply.
